Welcome to Nudge! These Terms of Service ("Terms") govern your use of the Nudge mobile application and website. By using Nudge, you agree to these Terms. If you don't agree, please don't use the app.
The Simple Version
Be respectful, don't abuse the service, and we'll do our best to help you stay connected with people you care about. If something goes wrong, we'll try to fix it, but we can't guarantee the app will work perfectly all the time.
1. Accepting These Terms
By creating an account or using Nudge, you agree to these Terms and our Privacy Policy. If you're using Nudge on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Eligibility
You must be at least 13 years old to use Nudge. By using the app, you represent that you meet this age requirement.
3. Your Account
Account Creation
- You'll need to provide a valid phone number to create an account.
- You're responsible for keeping your account secure.
- You may not share your account with others.
- You must provide accurate information.
Account Termination
- You can delete your account at any time from the Settings screen.
- We may suspend or terminate your account if you violate these Terms.
- Upon termination, your data will be deleted as described in our Privacy Policy.
4. How You Can Use Nudge
Nudge is provided for personal, non-commercial use to help you stay connected with friends and family.
You may:
- Use the app to set reminders and schedule calls with people you know
- Invite others to join Nudge
- Provide feedback and suggestions
You may NOT:
- Use Nudge for spam, harassment, or any illegal purpose
- Attempt to hack, reverse engineer, or compromise the app's security
- Use automated tools (bots, scrapers) to access the service
- Impersonate others or create fake accounts
- Violate any applicable laws or regulations
- Use the app to send unsolicited commercial messages
5. Notifications and Reminders
Nudge sends notifications to remind you to reach out to people. By using the app, you consent to receiving these notifications. You can control notification settings in your device settings or disable them in the app.
We are not responsible for failed message delivery due to network issues, device settings, or other factors outside our control.
6. Content and Data
Your Content
You own the data you put into Nudge (contact names, notes, etc.). By using the app, you grant us permission to store and process this data to provide the service, as described in our Privacy Policy.
Our Content
All Nudge branding, design, code, and other materials are owned by us or our licensors. You may not copy, modify, or distribute them without permission.
7. No Warranty
Nudge is provided "as is" without warranties of any kind. We do our best to keep the app running smoothly, but we can't guarantee:
- That the app will always be available or error-free
- That reminders will always be delivered on time
- That data won't be lost (though we do regular backups)
- That the app will work perfectly on all devices
Use Nudge at your own risk. We're not liable if a missed reminder causes you to miss an important call or event.
8. Limitation of Liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of Nudge, including:
- Lost data or missed reminders
- Relationship issues (we hope this doesn't happen!)
- Device damage or data charges
- Any other issues arising from use of the app
Our total liability to you for any claims related to Nudge is limited to the amount you paid us in the past 12 months (currently $0, as Nudge is free).
9. Indemnification
You agree to defend and hold us harmless from any claims, losses, or damages arising from:
- Your use of Nudge
- Your violation of these Terms
- Your violation of any rights of others
10. Changes to the Service
We may update, modify, or discontinue Nudge at any time, with or without notice. We're not liable if we change or discontinue any part of the service.
If Nudge is discontinued, we'll do our best to give you reasonable notice and allow you to export your data.
11. Changes to These Terms
We may update these Terms from time to time. If we make significant changes, we'll notify you through the app or via email. Continued use of Nudge after changes means you accept the new Terms.
12. Third-Party Services
Nudge integrates with third-party services (e.g., phone/messaging apps for calling). We're not responsible for these third-party services or any issues arising from them.
13. Governing Law and Disputes
These Terms are governed by the laws of the United States and the state where Nudge is operated, without regard to conflict of law principles.
If we have a dispute, let's try to resolve it amicably first. Contact us at support@getnudge.dev to discuss any issues.
If we can't resolve a dispute informally, you agree that any legal action must be brought in the courts located in [Your State/County], and you consent to jurisdiction there.
14. Severability
If any part of these Terms is found to be unenforceable, the rest of the Terms will remain in effect.
15. Entire Agreement
These Terms, along with our Privacy Policy, constitute the entire agreement between you and Nudge regarding use of the service.
